Corvis Reports on Ciena Lawsuit

Says interim verdict of patent court case was 'favorable' to Corvis, but another trial seems likely

COLUMBIA, Md. -- Corvis Corporation (NASDAQ: CORV), a leading provider of intelligent optical networking solutions, announced today that a favorable interim verdict was reached by a jury in the U.S. Federal District Court of Delaware in its patent litigation with Ciena Corporation.

Corvis all-optical networking products were found not to infringe two of Ciena's WDM system patents. The jury did not reach a verdict on a third Ciena WDM system patent, which is related to the two non-infringed WDM system patents. Corvis' inverse multiplexing transceiver product, which can be used along with other Corvis products, was found to infringe a Ciena patent on bit rate transparent devices.

"We are pleased the jury found that Corvis all-optical networking products do not infringe Ciena's WDM system patents," said Dr. David Huber, chairman and CEO of Corvis. "Corvis remains firm in its belief that our products have always been, and will continue to be, designed to respect the intellectual property rights of others, including Ciena."

The company indicated that the Court has not yet determined additional issues regarding infringement. The company plans to pursue further legal remedies, if necessary. The company believes that Ciena will request a new trial with a new jury on the patent on which no verdict was reached. The Northern Virginia office of Pillsbury Winthrop, LLP, is providing legal counsel to Corvis.
