Seeing as how the FCC is not mentioned by name in or created by the Constitution, I'm not sure how a Constitutional crisis could be brought on by the prospect of a temporary bout of FCC ties...but if someone wants to take to the streets nonetheless, well, they could do that, I suppose.

And speaking as an industry pundit/consultant in my own right, option 2 just seems like weird conspiracy theory to me.  IMHO.  I'm kind of a cynicist, sure, but cynical in the opposite direction -- if that makes sense.

If there was a way to vote two options, I would vote 3 and 5.  An effect, sure, but minor and temporary.

Worth pointing out that the Supreme Court has been managing with 8 justices reasonably well for much longer.  Not too concerned.
