Symbol Technologies sues Hand Held Products for infringement of 12 patents for imager-based bar code readers, integrated terminals, and engines

HOLTSVILLE, N.Y. -- Symbol Technologies, Inc. (NYSE:SBL) today announced that it had filed suit in the United States District Court for the District of Delaware against Hand Held Products, Inc. (which formerly was known as Welch-Allyn Data Collection, Inc.) and HHP-NC, Inc. (a wholly owned subsidiary of Hand Held Products, Inc.) for infringement of 12 Symbol patents. The asserted patents are focused on imager based bar code readers, integrated terminals (both batch and wireless) and engines. Some of the features included in the asserted Symbol patents include wireless communication and networking, optical character recognition, two-dimensional image capture functionality and exposure control. HHP earlier had accused Symbol of infringing certain of HHP's patents. Symbol's suit also seeks a declaration that 36 HHP patents are not infringed by any Symbol bar code scanning system or are otherwise invalid or unenforceable. "Symbol has invested millions of dollars in developing and acquiring the technology that is the subject of this lawsuit. It is incumbent upon Symbol to assert its rights to the benefits of its intellectual property when the Company's technology is misappropriated by others, such as HHP," Leonard H. Goldner, Symbol Executive Vice President and General Counsel, said, adding that Symbol will be seeking both damages and injunctive relief in the lawsuit. Symbol Technologies Inc.
