Huawei Granted Injunction Against ZTE

2:25 PM -- Huawei Technologies Co. Ltd. has landed the first blow in its patent scrap with rival Chinese vendor ZTE Corp. (Shenzhen: 000063; Hong Kong: 0763) by gaining a preliminary injunction in a German court. (See Huawei vs. ZTE – FIGHT!!)

The injunction, issued by a Hamburg court, relates to an alleged trademark infringement and prohibits ZTE from distributing certain USB modem sticks. (See Huawei Sets Lawyers on ZTE.)

"Huawei has received the injunction as part of our legal claim that ZTE is infringing on our trademark," states Huawei's head of corporate communications, Ross Gan, in a short statement emailed to Light Reading to announce what Huawei refers to as "its victory." Gan added: "We welcome the decision, which will protect our innovation and intellectual property."

According to a Bloomberg report, the injunction was issued following a fast-track proceeding on May 2, only days after Huawei announced it had issued legal proceedings against ZTE.

As ZTE now has the right of appeal, this looks like a legal punch-up that's likely to go the distance.

Now, this should be fun - one chinese company battling it out with another chinese company. Can't wait for the outcome.

Wonder if the chinese government is going to intervene ...
